EU Legistlation

Thanks to EU legislation, you are eligible to claim compensation for flight delays, overbooking, cancellations, flight re-routing and denied plane boarding. This applies if:

  • Your flight departed from any airport in the EU, Norway, Switzerland, or Iceland.

Flight Delay Compensation Options

If you're eligible for flight delay compensation, there are a number of ways that you can attempt to complete the claims process:

  • Send a letter to the airline yourself and hope that they respond to your claim.
  • Contact the Civil Aviation Authority (CAA) or other relevant European aviation authority, and get them to consider the claim on your behalf.

1 - Making a Claim Yourself

If you choose to contact the airline yourself, you may be waiting many months to get a response. In theory, this will save you money, but a majority of airlines are rejecting claims sent directly because in the hope that you will give up and just stop trying. If you have spent hours recovering your flight information and filling in paperwork just to be rejected, you may become frustrated and it might not seem worth the effort at all. If you then take it to the next step, and issue proceedings you will have to pay out Court fees, and you will need to navigate your way through the Court process, and you will probably find that your Court proceedings are defended by the airline's lawyers.

2 - Using the CAA

The second option is to let the CAA deal with your flight compensation claim. This method might prove more effective than dealing with the case on your own, but many claimants have found that this just simply isn’t the case. You will have to wait for the CAA to send everything to the airline and then wait for a response, and the response may still be argued to the very end, even if you have a legitimate case. Additionally, the CAA may be backlogged with claims due to the recent buzz around flight delay compensation. There are two other points to bear in mind. Firstly any recommendation of the CAA is not binding on the airline and we have known the airlines to simply ignore decisions recommending the airline to compensate the passenger if the airline happens not to agree – at which point the frustrated passenger is back to square one. Secondly and most importantly the CAA are very likely to apply something called the NEB guidelines, most claimant representatives believe these guidelines are biased in favour of the airlines, and that they do not correctly reflect the current state of European law as handed down in various national and European Court decisions. If the cause of your delay was a technical defect, by approaching the CAA, there is a risk you could be wasting your time and delaying your claim, if the CAA applies incorrect legal principles.
